Abstract In 2014, Ukraine experienced armed aggression, which could not but affect the complex of determinants of crime in the state. Occupation of parts of the territory provoked the massive internal displacement of people who lived on them. Moved persons were eventually given the status of “internally displaced person” (hereinafter in the text of the IDP is used in the plural – Y.T.). At the new location of the IDP, they faced a large number of problems, for which they were sometimes chosen in an unwarranted manner. In the future, in order to obtain objective conclusions regarding the crimes committed by the IDP, it was necessary to conduct a questioning of the prosecutors of the Ukrainian Prosecutor’s Office (in the areas of concentration of IDP) in order to more thoroughly study this issue.
The purpose of the article is to publicize the results of the questionnaire of prosecutors of the prosecutor’s offices of Ukraine and to conduct a criminological analysis of the state of crime among internally displaced persons in Ukraine on the basis of the above questionnaire.
During the survey, the method of questioning was used. Questionnaires are effective and widely used in criminology by the method of data acquisition. Therefore, given the absence of official statistics from law enforcement authorities on the commission of IDP crimes by 2017, such data was generated on the basis of an array of information collected and analyzed by conducting a questionnaire for public prosecutors of the Ukrainian Prosecutor’s Office in the places of the highest concentration of IDP.
According to the results of the study, it was concluded that in the regions of the highest concentration of IDP (namely, Donetsk, Luhansk, Kharkiv, Zaporizhzhia, Dnipropetrovsk, Odesa oblasts and Kyiv), the proportion of positive responses by prosecutors to cases of IDP crimes is proportionally higher. The perpetrators of crimes with the status of IDP are, in most cases, characterized by prosecutors as victims of circumstances in which they have appeared after an internal displacement. According to the author, internal displacement is a background phenomenon of crime. Also, with the help of the questionnaire, a number of difficulties were discovered that the prosecutor undergoes when supervising the observance of laws during the pre-trial investigation. Elimination of such problems can serve as the subject of further research.
